RECORD A LIEN NOTICE
Utah gives owner associations and condominium associations liens against delinquent properties to secure the payment of dues, assessments, fines, late charges, and interest owed to the association on that property. Associations can inform delinquent property owners and others of their liens by recording lien notices in the county recorder’s office. These notices give the association’s liens priority over later-filed liens and can prevent delinquent properties from being sold or refinanced. Recording these notices gives the association the ability to recover the attorneys’ fees it incurs enforcing its liens.

Deny Access to Recreational Facilities
In Utah, condominium and owners’ associations may terminate an owner’s right to access and use the association’s recreational facilities if the owner has failed to pay an assessment owed to the association. The association may also terminate a delinquent owner’s right to receive a utility service that is furnished by the association and funded with members’ dues. To do this, the association must first provide the owner with written notice of its intent to terminate the owner’s rights and the notice must comply with Utah’s laws. The termination must also be permitted under the association’s declaration, bylaws, or rules.

Step 2: Intercept Lease Payments
Second, if payment wasn't made after the warning, the association must deliver a Notice of Redirected Lease Payments to the tenant. When this notice has been provided, the tenant must make all future lease payments to the association until the owner’s delinquency has been satisfied.
